When do I tell the court that I will call witnesses in a Small Claims lawsuit?

In a Small Claims lawsuit, you are not required to disclose in the Notice of Claim or the Reply who you may call as a witness.  Quite often, if the parties cannot settle their dispute at the Settlement Conference, then the judge may order that the parties must exchange the names of the witnesses that the parties will call at trial, their contact information, and a short summary of what each witness is likely to say at trial.

Witnesses do not appear or speak at a Settlement Conference in a Small Claims action.

Each party is responsible to pay for their own witnesses' expenses in Small Claims.
